PRIVACY POLICY

OGORI JSC's Privacy Policy is the basis for customers - Users to clearly understand the personal information that we will collect and the reasons why we need to collect this information from you. We are committed to implementing the use of customer information in accordance with the given policy.

1. DEFINITION

1.1. We are: OGORI BLOCKCHAIN VIETNAM TECHNOLOGY AND SOLUTIONS JOINT STOCK COMPANY

English name is: VIETNAM OGORI BLOCKCHAIN TECHNOLOGY AND SOLUTIONS JOINT STOCK COMPANY

The abbreviation is OGORI JSC. Is a company legally established and operating in the field of Information Technology under the laws of the Socialist Republic of Vietnam, with a Certificate of Business Registration.

1.2. OGORI application: is a Blockchain platform for traceability and production management according to the value chain researched and developed by OGORI BLOCKCHAIN VIETNAM TECHNOLOGY AND SOLUTION JOINT STOCK COMPANY (OGORI JSC), including a set of mobile applications, management applications (Web platform), origin traceability portal via QR code and Block Explorer application to verify information stored on Blockchain. All of the above components operate on the Blockchain network platform.

1.3. OGORI Account: is an electronic account created on OGORI's information technology system by the User and managed through various forms, including but not limited to mobile applications, websites and other forms to access and use the application..

1.4. Users: are customers who need to use the OGORI application.

1.5. API (Application Programming Interface): is an application programming interface.

1.6. OTP: is a one-time password.

2. SCOPE OF APPLICATION

This policy regulates how OGORI collects, uses, and secures information applicable to information provided by Users when using OGORI Accounts via the OGORI Application on mobile phones/websites or through third parties using OGORI's API.

3. PURPOSE OF INFORMATION COLLECTION

The User agrees that OGORI has the right to collect, use, store, disclose and exchange information about the User, information related to the User and any transactions related to the User through the OGORI Account for the following purposes: 

The information we collect will be used for the following purposes:

3.1. Application Support: OGORI uses the information collected to provide, maintain and improve OGORI features. Including:

3.1.1. Automatically update personal information (Full name, Business name, Email, Phone number, Address) of the User while filling in information fields on the application

3.1.2. Remember information so that the User does not have to re-enter it during access or the next time the User accesses.

3.1.3. Automatically update the OGORI Application on the User's device, handle software errors, operational problems, analyze data, test and research.

3.2. Safety and security: OGORI uses User information data to maintain the safety, security and integrity of the OGORI application.

3.3. Customer support and answering questions: In the event that the User contacts OGORI's Customer Support Department and after obtaining the User's consent, OGORI uses the collected information including recordings of support and customer care calls to: 

3.3.1. Resolve User inquiries and complaints.

3.3.2. Monitor and support customers during service use.

3.4. Research and development: OGORI may use the collected information for research and survey purposes with the aim of: (i) improving and overcoming limitations in the use of the application; (ii) developing new features; 

3.5. Communications from OGORI: OGORI may use the information collected to communicate with Users about promotions, research, surveys, news, updates, events, advertisements and related content about the OGORI application.

3.6. Provide information and data related to product information that farmers and production units update on blockchain through the OROGI application.

The communication channels that OGORI will use to communicate with Users include:

3.5.1. Send text messages (SMS) or call the User's phone number according to the information OGORI collects from the User;

3.5.2. Send email to the User's email address according to the information OGORI collects from the User;

3.5.3. Notice on website https://ogori.vn/ and OGORI fanpage on Facebook https://www.facebook.com/ogori.blockchain/ 

3.6. Implementation of legal procedures and requirements

OGORI may use the information collected to

3.6.1. Investigate or resolve complaints or disputes related to the use of the OGORI application from Users;

3.6.2. Carry out other activities permitted by applicable law; 

3.6.3. Provide to competent state agencies or provide information as required by law.

4. INFORMATION COLLECTED

541 We may collect and process the following types of information from users:

Personal Information: Name, email address, phone number, address and account related information.
Transaction Information: Information about in-app purchases and transaction history.
Device Information: Information about your mobile device (such as device model, operating system version, and device identifier).
Location Information: Your location (if you allow it) to provide customized services and location-appropriate support.
Camera information: We request access to your camera so users can scan product barcodes and perform other functions in the app.

Media: When you upload images, videos or other materials (collectively, “Media”), we will store and process this information for the purpose of providing the Service. You warrant that the Media you submit does not infringe the intellectual property rights or privacy rights of any third party.

4.1. Information when the User opens an OGORI Account

4.2. Information sent by OGORI to Users

4.2.1. Contact OGORI via hotline, application, website and social network accounts;

4.2.2.. Survey results when Users perform the survey feature on the OGORI Application or website ogori.vn;

4.2.3. Enable features that allow OGORI to access the User's device camera or location.

4.3. Information generated when Users use the OGORI application

4.3.1. Update OGORI Account information. 

4.3.2. If permitted by the User, OGORI will collect the location information of the User's access device; OGORI will collect the User's exact or approximate location information through data such as GPS, IP address and WiFi. When the User fills in the business address, the User's location will automatically be displayed on the map;

4.3.3. Usage and Preference Information: OGORI collects information about how Users interact with OGORI applications, the preferences and settings selected. In some cases OGORI collects information through the use of cookies, pixel tags and similar technologies that allow the creation and maintenance of unique User identifiers;

4.3.4. Device Information: OGORI may collect information about the device the User uses to access the OGORI Application, including hardware model, operating system and version, software, file name and version, preferred language, unique device identifier, advertising identifier, serial number and mobile network information;

4.3.5. Update history information: When Users interact with the OGORI application, OGORI collects server logs, which may include information such as time, actions, accounts performed, etc.

4.4. Other information OGORI needs to collect to comply with legal obligations

OGORI will require the User to provide information related to the use of OGORI's application that OGORI may reasonably request for the following purposes:

4.4.1. Assist OGORI in complying with its obligations under the law;

4.4.2. Report to competent state agencies as prescribed;

4.4.3. Assess whether the User has complied, is complying and is likely to continue to comply with all of its obligations under the OGORI Policy.

5. SCOPE OF INFORMATION USE

5.1. In addition to the purposes stated in this Policy, OGORI commits not to transfer, lease, disclose, or share User information to any third party without the User's consent or in accordance with the law or at the request of competent state agencies.

5.2. Purpose of sharing and disclosing information

5.2.1. At the request of the User, including:

Share User information with third parties such as partners and cooperating businesses at the request of the User;

For purposes of these Terms, third parties may be: (i) other applications or websites that integrate OGORI's API; (iii) or OGORI's business partners.

In the event that OGORI shares information with third parties, to ensure the confidentiality of User information, OGORI and third parties will clearly and strictly stipulate the requirements for third parties to be responsible for the confidentiality of User information based on the terms and conditions that OGORI has committed to the User according to the provisions of this Policy.

5.2.2. With the public when Users post content to public forums established by OGORI, including: Information posted by Users on public forums such as OGORI's fanpage, VBC on Facebook or other social networks.

5.2.3. According to the provisions of current law or at the request of competent state agencies, including: 

Share with prosecution agencies and administrative management agencies;

Carry out periodic and ad hoc reports as required by other state management agencies;

OGORI may also access, protect and share information when OGORI has a basis to detect, prevent and address fraud and other illegal activities.

5.2.4. With User's consent.

6. RIGHT TO ACCESS AND EDIT USER INFORMATION

6.1. The User has the right to request OGORI to check, update, adjust and cancel the User's information. OGORI is obliged to check, update, adjust and cancel the User's information upon request or provide tools for the User to check, update and adjust the User's information.

6.2. Unsubscribing from email marketing newsletters: Users may opt-out of receiving marketing emails from OGORI by contacting OGORI directly through any contact information on OGORI's website, applications or social networks.

6.3. Stop receiving OGORI application notifications from the access device permissions by customizing the access device permissions according to the regulations of the mobile platforms (iOS, Android, etc.).

7. PROTECTION OF PERSONAL INFORMATION

We are committed to protecting users' personal information by:

  • Use industry standard security measures to prevent unauthorized access to personal information.
  • Limit access to personal information to only those employees and partners necessary to perform the relevant services.

8. INFORMATION STORAGE PERIOD

Your personal information will be retained for as long as necessary to fulfill the purposes set out in this Privacy Policy, or as required by applicable law.

9. USER RIGHTS

You have the right to:

Request access to your personal information that we hold.
Request to correct or delete inaccurate personal information.
Withdraw your consent to the processing of personal information at any time (within legal limits).

10. MEASURES TO ENSURE INFORMATION SECURITY

10.1. OGORI commits to and uses reasonable methods to ensure the safety and security of collected personal information to prevent acts of theft, access, change, and unauthorized destruction of information;

10.2. OGORI will implement various security measures to ensure the safety of User data on the system. User data is stored in a secure network system and can only be accessed by a limited number of OGORI employees. 

10.3. OGORI will retain User information data in accordance with applicable laws. OGORI will destroy it as soon as it is reasonably certain that: (i) the purpose for which the information data was collected is no longer appropriate for retaining the data; or (ii) retention is no longer necessary for any legal or business purpose; or (iii) the User has no need or has completed using the OGORI Account.

10.4. OGORI also recommends that Users take measures to protect their OGORI Account by not providing, exchanging accounts and providing login passwords or OTPs to any other third party. If the User shares a computer or mobile device with another User, the User should not choose to save login information (e.g. user ID and password) on that shared device and log out of the User's OGORI Account. OGORI is not responsible for the loss or disclosure of User information due to the User's actions in this Clause.

11. Cookie Policy

Our App uses cookies to improve your experience. Cookies are small data files stored on your device. You can adjust the cookie settings in your browser, but this may affect your ability to use the App.

12. Other regulations

12.1. OGORI's failure to exercise or enforce any right or remedy available to it under this Policy or by law shall not be deemed a waiver or limitation of such right or remedy by OGORI.

12.2. In the event that any provision of this Policy is determined to be unlawful or otherwise unenforceable, OGORI may modify such provision, or remove such provision from this Policy at its sole discretion. This will not affect the remaining provisions of this Policy, which will remain in full force and effect.

12.3. The User acknowledges that OGORI, pursuant to applicable laws and regulations or upon receipt of instructions from relevant government authorities, may be required to take actions that may violate the provisions of these Policies. In this regard, the User agrees not to hold OGORI liable.

12.4. This Policy shall be binding on the User's heirs, personal and legal representatives, successors in title and permitted assigns in the assets (if any).

12.5. Any dispute or disagreement under this Policy shall first be resolved through conciliation negotiations. If no agreement is reached through such conciliation negotiations, the parties hereby agree to submit the dispute or disagreement to a competent court in Ho Chi Minh City for resolution.

12.6. Disputes between Users and third parties: OGORI has no related responsibilities but only plays a supporting role for Users, providing necessary information for Users and related third parties to resolve together. Users and third parties must directly resolve all issues related to transactions between Users and third parties. In case of complaints, disputes, etc., OGORI has the full right to block the related OGORI Account until the issue is resolved or there is a final decision by the competent state agency.

OGORI Users must read, fully understand and fully agree with the contents of this Policy.

14. CHANGES TO PRIVACY POLICY

We reserve the right to update and change this Privacy Policy. Any changes will be notified via the app or via email. You should review this Privacy Policy regularly to stay informed of the latest information.
